IMPORTANT: PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE BATTLEWARZ WEBSITE AND SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.

These Terms of Service ("Terms") govern your access to and use of the Battlewarz website, applications, and services (collectively, the "Services") provided by Battlewarz ("we," "us," or "our").

1. ACCEPTANCE OF TERMS

By creating an account, voting, commenting, or otherwise using the Services, you affirm that you are at least 13 years old and agree to comply with these Terms and our Privacy Policy.

2. YOUR BATTLEWARZ ACCOUNT

You may register for an account to participate in voting, commenting, and accessing certain features. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Promptly notify us if you discover or suspect any security breaches related to the Services or your account.
• Be solely responsible for all activities that occur under your account.

3. SIMULIVE BATTLE PLATFORM

Battlewarz operates as a simulive battle platform. This means:

• Battles are pre-recorded and premiered at scheduled times for the community to watch together.
• All performers and battles are organized and managed by Battlewarz staff.
• Users cannot create their own battles or upload battle content directly to the platform.
• The voting system allows the community to vote for their preferred performer during designated voting periods.

4. USER CONDUCT AND RESPONSIBILITIES

You agree not to use the Services to:

• Submit, post, or transmit any content (including comments or profile information) that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, ethnically, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Engage in any activity that interferes with or disrupts the Services.
• Attempt to gain unauthorized access to any portion of the Services, other accounts, or computer systems.
• Use any automated means (e.g., bots, scrapers) to access the Services, collect information, or manipulate voting.
• Create multiple accounts to influence voting outcomes.
• Violate any applicable local, state, national, or international law.

5. COMMENTS AND USER-GENERATED CONTENT

Ownership and License

You retain ownership of the content you submit to the Services ("User Content"), such as comments. By submitting User Content, you grant Battlewarz a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content in connection with the Services.

Responsibility

You are solely responsible for your User Content. We reserve the right to remove User Content without prior notice if it violates these Terms or is otherwise deemed inappropriate.

6. VOTING RULES

• Voting is available during designated voting periods for each battle.
• Each user may cast one vote per battle.
• Any attempt to manipulate votes using multiple accounts, automated scripts, or other means is strictly prohibited.
• Battlewarz reserves the right to review voting patterns and take action against users violating these rules.
• The "People's Champion" award is determined by community vote during the voting period.

7. INTELLECTUAL PROPERTY

All battle content, videos, and materials on the Services are the property of Battlewarz or its licensors. Users may not download, reproduce, or redistribute battle videos without express permission.

8. TERMINATION

We may terminate or suspend your access to the Services, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

9. DISCLAIMERS

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICES IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BATTLEWARZ, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.

12. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
